These two states have an intellectual property law governing employee internet access and email communications. Pursuant to Connecticut and Delaware's respective state code, employers must provide notice to employees before monitoring internet access or email communications. Some of the central provisions include the following:
(1) $100 in civil penalty per violation (Delaware Code); from $500 for the first offense to $3000 for the third and subsequent offenses (Connecticut Code);
(2) an exception to the notice requirement for employers in cases involving unlawful behavior on the part of the employee and where electronic surveillance may demonstrate proof of the illegal conduct (Connecticut Code); and
(3) exceptions for court-ordered actions and protection or maintenance of the computer system (Delaware Code).
