Also known as TESS, the Trademark Electronic Search System is a tool for protecting website intellectual property. It offers public access to a database of trademarks and enables applicants to run searches of current registration information and trademark application. The trademarks listed on the TESS database are strictly those that are pending or are Federally-registered. For the creation of a trademark and patent website, a consumer must also acquire a patent, which he or she can do by completing the following steps:
(1) Finding out whether the concept is already patented by running a search in the Patent Full-Text and Image Database;
(2) Verifying the fee schedule for instructions concerning the patent process and current fees;
(3) Submitting a patent application through the Electronic Filing System as an Unregistered or Registered eFiler;
(4) Reviewing the status of an existing patent application by utilizing the Patent Application Information Retrieval (PAIR) system; and
(5) Ensuring patent maintenance by submitting maintenance fees though the Revenue Accounting and Management System.
